1. Scope and acceptance

These Terms of Service govern your use of the Tendle iOS App and this website (together, the "Service") operated by Nils Schiwora, trading as Nils Schiwora Trading Services, Ahornstr. 37, 14547 Beelitz, Germany — see the Imprint.

By installing the App or using this website beyond purely informational browsing, you agree to these Terms. If you do not agree, please stop using the Service.

In addition to these Terms, the App Store's standard terms (Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement) apply between you and Apple. Where those terms conflict with ours on a point Apple is responsible for (billing, account management, refunds), Apple's terms prevail for that point.

2. What the Service does

Tendle helps you be present with your young child. During "kid time", the App blocks the distracting apps you chose, using Apple's Family Controls (Screen Time). You earn your phone back by photographing an artefact of your play together — for example a block tower — which is verified on your device. The App keeps a streak and counts your present minutes.

Tendle is a gentle nudge, not a parental-control or child-safety product. It blocks your own apps for a session you start; it is not designed to supervise, restrict, or monitor a child, and it is not a substitute for your own judgement about screen use. The App is local-first: there are no user accounts.

3. Eligibility

  • You must be at least 16 years old to use the App. If your country sets a different age of digital consent under Art. 8 GDPR, that age applies.
  • Tendle is meant to be used by the parent, on the parent's own device. You are responsible for keeping your device and Apple ID secure. We treat anyone signed into your device as you.
  • We may decline service to anyone whose use violates these Terms, the law, or third-party rights.

4. Subscriptions ("Tendle Plus")

Tendle includes a paid subscription called Tendle Plus, sold through the Apple App Store. Subscriptions are managed by Apple, not by us directly.

  • Products and trial. Tendle Plus is offered as a weekly plan without a trial and a yearly plan with a free trial (currently 7 days). Apple's checkout always shows the current price, billing period, and trial terms for your region and is the binding source for them.
  • Auto-renewal (App Store required disclosures). This subscription is auto-renewing. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of the current period at the same price unless the price has changed. A free trial converts into a paid subscription unless you cancel at least 24 hours before the trial ends.
  • How to cancel. You can cancel any time and keep your features until the end of the paid period: open the Settings app → tap your name → Subscriptions → Tendle Plus → Cancel Subscription, or open https://apps.apple.com/account/subscriptions on your device.
  • Restore purchases. If you reinstall or switch devices, use the restore-purchases option in the App to re-link your existing subscription via your Apple ID.
  • Refunds. Apple handles all refunds for App Store purchases; we cannot issue or refuse them ourselves. Request a refund at https://reportaproblem.apple.com.
  • Price changes. Any price change applies to future renewals only, never retroactively. Apple notifies you of material price changes and, depending on Apple's rules, may require your explicit consent before charging the new price. You can decline by cancelling before the next renewal.

5. Right of withdrawal for EU consumers

If you are a consumer with habitual residence in the EU, you have a 14-day right of withdrawal starting on the day the subscription is concluded (§ 355, § 356 BGB). Because the App Store provides the subscription as digital content immediately on purchase, you can lose the withdrawal right once provision has begun — provided you gave prior express consent to immediate provision and acknowledged that you lose the withdrawal right with the start of performance (§ 356 (5) BGB). Apple's purchase flow presents this consent step. To exercise the withdrawal right where it still applies, the most practical route is Apple's refund flow at reportaproblem.apple.com; you can also send an unambiguous withdrawal statement to support@tendle.me and we will help you escalate to Apple.

6. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, disassemble, or otherwise try to derive the source code of the App, except to the extent this is permitted by mandatory law (e.g. § 69e UrhG for interoperability).
  • Use the Service to harass, threaten, defame, or impersonate anyone.
  • Use automated means (scrapers, bots) to access the Service in a way that imposes an unreasonable load on it.
  • Circumvent any usage limits, paywalls, or security mechanisms — including the verification step that earns back your phone.
  • Use the Service in violation of applicable export-control or sanctions law.

7. Intellectual property

The App, this website, the brand name "Tendle", and all related design, copy, and code are owned by Nils Schiwora Trading Services or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal and non-commercial purposes, for as long as these Terms allow.

You retain rights to content you create, including the photos you take in the App — those stay on your device. By submitting feedback or bug reports, you grant us a non-exclusive, royalty-free, perpetual licence to use that feedback to improve the Service.

8. Disclaimer

The App is a presence aid, not a safety, supervision, or parental-control service. Do not rely on Tendle to keep a child safe, to supervise a child's device, or to enforce screen rules on anyone but yourself. You remain responsible for the care and supervision of your child at all times, including while a kid-time session is running. To the extent permitted by law, we are not liable for outcomes that arise from relying on the App for anything beyond gently pausing your own apps.

9. Limitation of liability

We are fully liable for damages caused intentionally or by gross negligence, for damages from injury to life, body or health resulting from a breach of duty by us or our agents, and for any other liability that cannot be excluded under mandatory German consumer law (in particular the Produkthaftungsgesetz, where applicable).

For slight negligence, we are liable only for breach of an essential contractual duty (a duty whose performance makes proper performance of the contract possible in the first place and on whose observance you may regularly rely). In that case, our liability is limited to the foreseeable damage typical for this type of contract, and in any event capped at the amount you paid us in the 12 months preceding the event giving rise to the claim.

We are not liable for indirect or consequential damages outside the cases described above.

This Section 9 applies to all claims, regardless of legal basis, including tort.

10. Term and termination

You may stop using the App at any time. Subscription cancellation is described in Section 4. You can remove the data the App stores on your device at any time via Settings → Delete local data.

We may suspend or terminate your access if you materially breach these Terms, after a reasonable warning where possible. We may discontinue the Service as a whole with at least 30 days' notice; in that case, we will work with Apple to refund any unused, pre-paid subscription period.

11. Changes to the Service and to these Terms

We may change features of the Service from time to time. If a change materially reduces a paid feature, we will tell you in advance and you can cancel as described in Section 4.

We may update these Terms. We will notify you of material changes at least 14 days before they take effect in the App or on this website. If you do not agree to the new Terms, stop using the Service before they take effect; continued use means you accept the new Terms.

12. Governing law and jurisdiction

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer-protection provisions of the country where you have your habitual residence remain unaffected.

The European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

13. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the rest remains in force.
